Navy Dads

Son absolutely refuses to discuss a vehicle loan for $12,000 he has decided to abandon on us since we are on the loan as well. Been lying to us about payments in the mail that never comes, then just starts fabricating lies, I forgot to put a stamp on it, I addressed it to myself, the lies just never stop. He promised us he would set up automatic payments, those were always "pending " on his Navy Federal Account. We have been trying several times a day to call but he won't take the calls, we have texted him and he stated that he wasn't going to pay for the car & to leave him alone. Unfortunately, since he absolutely refuses to talk directly to us (even stated he wasn't on his last text), we are left no other option except to contact his Commanding Officer to assist us. We have come to realize that we can't make him be an honorable man with integrity and pay this debt or even pay a portion of the upside down $5,380 so we decided to trade in the vehicle and need his signature on several documents. He still refuses to talk to his father so we can explain all he needs to do is sign the papers and he's done. Last text stated, I made up my mind. Where do we start with this process?

Hi Jim & Paul

After much prayer, God has led us to the decision to allow Josh to walk away completely free of this debt. We know God is in control and is going to bless us through this trial.
Our attorney has sent a final letter of opportunity for Josh to sign the power of attorney for the vehicle to be sold and the loan to be paid in full by his father (& I). He has been given this opportunity over a week ago before we spoke to our Attorney on Friday yet he still has not signed the POAs. If he does not respond to the attorney per her request by Tuesday, she will then contact his Master Chief. God is in control of all of this. We continue to pray for Josh. I will let you know on Tuesday what decision Josh has made.

That is all you can do....you make a decision and hope that the Lord guides you in that process....hold your head high as life will continue and you did your best to resolve the issue. 

Any news? Good I hope...

Not good news. As a matter of fact, we have not received any help from Josh's Master Chief. He actually told Bryan (dad) that he would get with Josh, discuss and they would call Bryan back so all can discuss. Never happened. However, later that evening after three attempted calls to Josh by Bryan, Josh finally took his call. Promising he would sign the title release power of attorney and send it out. Once again, it never happened. I cannot believe that our US Military would condone such behavior. He continues to lie to us, this situation is going to end up forcing a repossession for my husband and Joshua. Apparently he does not care about his credit and that's his business, but to willfully and purposely see to it that his dad's is ruined is another thing. Joshua has been given a gift of zero debt, zero consequences, zero credit delinquency, yet will not sign the title release to end it all. He keeps saying the document he received is in the Legal Dept. I need help Jim. No one can do anything with that Vehicle without Bryan and Joshua. I'm not convinced the document is in some Legal Office. When someone lies about any and everything you can't believe a word. Where do I start to get the information we need. Josh's decision to proceed in this manner, is causing more financial troubles, his dad could possibly lose his job should this car go into repossession.
Thank you Paul. I called another Master Chief and he explained some important information about what the Military can and cannot get involved in. He assured me that he would get with the Master Chief that Bryan spoke to last week and see what took place. He further assured me that he would personally call me back later in the day. One issue that no one we spoke to seemed to understand (or hear) is that Josh is the cobuyer on the loan and has refused to pay his debt. We know that no one can force him to sign that release and be done with this. Repossession is the final step. We don't want that, we did everything we can to prevent it. Once it goes into repossession, that's when he will realize that his credit worthiness and security clearance are tied together. Our credit too will be crap. Everyone says keep the car and drive it...well would you want to pay 100% for a car that you will only own 50% of? Never being able to sell it. Never being able to trade it in. Wondering when Josh will come back and claim 50% ownership. We will never understand why he chose this path.

This is why I was always saying you needed to protect yourselves from a legal standpoint....consider paying for the car while you continue to fight to resolve the issues.....a few months of payments may be better than the alternative.....just consider
